Arbitration
Arbitration is a form of alternative dispute resolution (ADR) It is a legal technique for the resolution of disputes outside the courts. This is a process through which two or more parties use an arbitrator, being a neutral impartial third party, to resolve a dispute.
Attorney ad litem
An Attorney ad litem is appointed by the court when there are parties that cannot be located, unknown, infirm parties or heirs that have been served by publication and a return filed with the court. An attorney ad litem can be needed in an Heirship case in a Probates matter, or with a party to a civil case where there is no service.
Estate Planning
Estate planning is the process involving the designation of your assets in the event of death or incapacitation. This process is often done with the guidance and services of your lawyer. It may also include other professionals, like your accountant, a financial planner, life insurance advisor, banker and broker. A Will is the core legal agreement associated with this process.
Guardian ad litem
Guardian ad litem is appointed when a party is a minor or is a party to a case where there is a claim of incapacity, like in a Guardianship Case filed in the Probate court.
Mediation
Mediation is a form of settlement conducted and assisted by an impartial attorney or person trained in the art of settling disputes. Unlike arbitration and other kinds of alternative dispute resolution, mediation is non-adjudicatory. The mediator makes no findings of fact or law, whether binding or non-binding.
Real Estate Transactions
When anyone is involved in Real Estate Transactions there is the opportunity to utilize a Realtor, or choose not to use a Realtor. There are recommendations for both.
